A recent Tribunal case is every trustee's nightmare, and a warning most business owners don't want to hear.

A trustee claimed they made a trust distribution decision by June 30 to access a lower tax rate.

On paper, it looked perfect.
Signed. Dated. Clean.

But the ATO dug deeper.
And found the "30 June" paperwork was actually created months later.

So the Tribunal threw the whole strategy out.

Outcome?
The default resident beneficiaries were hit with significantly higher tax, all because there was zero real evidence the decision happened before year-end.

Here's the part no one wants to accept:
The ATO does not care what your documents say.
They care about what really happened, and when.

If you can't prove timing, you don't have a distribution.
Full stop.

To protect yourself:
Take real-time minutes
Send a confirmation email to your accountant before June 30th.
Let the paperwork follow, but only if it reflects the truth.

If you rely on trust distributions, make sure the timing won't fail you. We can help you get it right before June 30.
